Terms of service
1. Acceptance of Terms
By commissioning artwork or making a purchase from Charlotte Coe, you (the Client) agree to these Terms and Conditions in full. A signed document is not required for these terms to apply.
Please read these Terms and Conditions carefully before proceeding. By using any services or placing an order, you confirm that you have read, understood, and accepted them.
2. Description of Commissioned Artwork
All commissioned paintings are created on high-quality stretched canvas, with canvas thickness specified prior to starting. The completed artwork will be sealed with a high-grade varnish to protect against dust, dirt, and UV damage.
Artwork may be based on:
- A personal photograph (e.g., a photo of your dog, a landscape scene)
- A stylized or design-based portrait,
- An abstract concept described and agreed upon at the time of quotation.
We will collaborate to choose the most suitable reference photo. The artist reserves the right to decline a commission if a sufficiently high-quality image cannot be provided.
3. Reference Photo Rights
If the Client does not own the reference photo, they must obtain written permission from the original photographer or copyright holder. This includes professionally taken photos. Commissions cannot proceed without the appropriate permissions.
4. Payment Terms
- Prices are subject to change prior to deposit.
- A non-refundable 50% deposit is required to secure a commission or original artwork.
- Once the deposit is paid, the price is fixed.
- Final payment (remaining 50%) must be made within 30 days of completion before the artwork is shipped.
If the final payment is not received within the 30-day window, the artwork will be returned to the market, and the deposit will be forfeited.
If the Client is unsatisfied and the issue cannot be resolved through minor alterations, the final balance will not be due—but the artwork will remain the property of the artist and may be offered for public sale (where no personal imagery is included, such as an animal painting).
5. Target Completion Dates
A target completion date will be agreed upon before any work begins. Once the artwork has been dispatched, shipping times are no longer the responsibility of the artist.
6. Delivery
- Artworks are shipped from the UK using tracked delivery, or can be collected in person.
- Tracking details will be provided.
- Overseas delivery charges vary please get in touch to discuss.
- All artworks are securely packaged to ensure protection during transit.
7. Returns & Damages
Returns are not accepted for reasons of change of mind.
In the rare event that an item arrives damaged prior to delivery or collection, the Client must notify the artist within 48 hours of receipt.
Return shipping for damaged items is the responsibility of the Client.
8. Copyright and Usage
The artist retains full copyright of all commissioned and sold artwork.
Images of the work may be used in portfolios, on the website, and on social media. For privacy, permission will be requested before publishing portraits of identifiable people.
Clients may not reproduce, sell, or distribute the artwork (or prints of it) without written permission from the artist.
9. Data Protection
To fulfil an order, the artist will collect the Client’s name, email, and address. This information will only be used for invoicing and delivery purposes. Once the artwork is delivered:
- Contact details will be deleted,
- Any saved or printed reference photos will be deleted or destroyed.
10. Progress Updates & Sharing
Progress photos will be shared with the Client as the work develops, and minor design changes can be requested during this phase.
Unless otherwise requested (e.g., for a surprise gift), the artist reserves the right to share work-in-progress images on social media.
If the artwork is a gift, images will not be shared publicly until after the recipient has received it.
